About The Unique Piece
The Unique Piece (“TUP”, “we”, “us”, “our”) operates an online marketplace platform based in Dubai, United Arab Emirates, dedicated to curated vintage, pre-owned, and second-life furniture and home décor.
TUP acts solely as an intermediary platform facilitating listings, escrow-based payments, delivery coordination, and dispute handling, and is not a party to the sale contract between buyers and sellers.
Eligibility & Account Use
You must be at least 18 years old to use the Platform and complete transactions.
You agree to provide accurate, complete, and up-to-date information when creating an account and to keep your login credentials secure. You are responsible for all activity conducted under your account.
Prohibited Account Use
You must not use the Platform to:
- Attempt to gain unauthorized access to any account, system, or data
- Hack, probe, or interfere with the security or operation of the Platform
- Scrape or use automated means to extract Platform content or data
- Upload or transmit malicious code, malware, or harmful scripts
- Impersonate another person or misrepresent your affiliation with any person or entity
TUP may suspend or terminate any account engaging in the conduct described above, without prior notice.
Product Nature & Condition
The Platform specialises in vintage, antique, and pre-owned items. By their nature, these items are not new and may show signs of age, use, patina, or minor imperfections.
- Listings include descriptions and photographs intended to accurately reflect the item's condition.
- Minor wear consistent with age and use is considered part of the item's character and not a defect.
- Any structural integrity issues, major damage, or restoration must be disclosed by the seller.
- Colors and finishes may vary due to lighting, photography, or screen settings.
Authenticity
Unless explicitly stated otherwise, items are listed based on seller representations and TUP's curation review. Formal third-party authentication is not guaranteed unless clearly indicated in the listing.
TUP's curation review assesses listings for presentation and general suitability for the Platform but does not constitute independent authentication of every item. Unless expressly stated in a listing, TUP does not guarantee authenticity, provenance, valuation, merchantability, or fitness for a particular purpose.
Orders & Payment (Escrow)
By placing an order, you commit to purchasing the listed item at the stated price. Payments are processed securely through TUP's payment partners. Prices are displayed in AED unless otherwise stated and may be inclusive or exclusive of VAT, as indicated at checkout.
Orders are not confirmed until payment has been successfully authorised and received. TUP reserves the right to cancel orders resulting from pricing errors, inaccurate listings, or technical issues.
If a listed item becomes unavailable before completion of the transaction, including where it has already been sold elsewhere, TUP may cancel the order and issue the buyer a full refund.
Commission & Seller Payouts
- TUP deducts its agreed marketplace commission and any applicable fees from the sale price before releasing funds to the seller.
- Seller payouts are released only after successful delivery, buyer acceptance, or expiry of the inspection period under Section 7, provided there is no active dispute.
VAT, Taxes & Invoicing
- Where the seller is a VAT-registered professional seller under UAE law, the seller is responsible for charging VAT at the applicable rate, issuing a valid tax invoice, and complying with all VAT obligations.
- Where the seller is an individual or non-VAT-registered seller, VAT does not apply and no tax invoice will be issued.
- TUP acts solely as a marketplace intermediary and is not the supplier of listed items for VAT purposes, unless explicitly stated otherwise.
- TUP does not assume responsibility for a seller's VAT registration status, tax compliance, or invoicing obligations.
- Any VAT applicable to TUP's service fees or commissions will be charged separately in accordance with UAE law.
Escrow Holding, Authority & Release
- Buyer funds are held in escrow and are not released to the seller until delivery or collection is completed and the item is accepted.
- TUP administers the escrow process and retains the authority to withhold, release, partially release, or refund escrow funds in accordance with these Terms.
- In the event of a dispute, claim, cancellation, failed delivery, or non-compliance, TUP may determine the appropriate handling of escrow funds. Such determinations are final and binding.
- Where applicable, TUP may deduct delivery costs, return handling fees, damage-related costs, or other reasonable charges before releasing any remaining escrow balance.
Delivery & Access
Due to the size and nature of furniture items, delivery arrangements may vary. UAE deliveries are typically scheduled within 3–5 business days, subject to logistics coordination and item size. International delivery may be available upon request, with buyers responsible for customs duties, taxes, and import requirements.
- Delivery timelines are estimates only and not guaranteed.
- Buyers are responsible for ensuring adequate access (including doorways, staircases, and elevators).
- Failed or refused deliveries due to access issues may incur additional fees.
- Risk transfers to the buyer upon successful delivery.
Pickup Documentation & Condition Records
Where delivery or collection is arranged through TUP or its logistics partners, the logistics provider may take photographs and/or videos of the item at the time of pickup to document its condition prior to transport. These images serve as a condition reference and may be used by TUP, the buyer, and the seller in the event of a claim or dispute.
Inspection, Claims & Disputes
Buyers must inspect items upon delivery. The 24-hour inspection period begins once delivery has been completed (or collection has taken place) and the buyer has taken possession of the item. Any issue must be reported within this 24-hour window and must include clear photos or videos, a written description, and reference to the original listing.
Valid Grounds for a Claim
Dispute Resolution
TUP will conduct an internal review of claims based on all available information, including listing details, delivery records, and evidence submitted by both parties. Following review, TUP will determine the appropriate resolution, which may include releasing escrow funds, issuing a partial or full refund, or arranging a return. Escrow funds remain on hold until the dispute is resolved.
TUP's determination is final and binding, unless otherwise required by applicable law.
Bad-Faith or Abusive Claims
TUP reserves the right to reject, suspend, or limit claims deemed abusive, repetitive, unfounded, or made in bad faith. Appropriate action may be taken, including claim restrictions, account suspension, or termination.
Returns & Refunds
- Returns are not accepted for change of mind.
- Refunds are issued only where a claim is approved under Section 7.
- Approved refunds may exclude delivery or handling costs depending on the circumstances.
- Returned items must be in the same condition as delivered. Additional damage may void refund eligibility.
Seller Responsibilities
Sellers are responsible for ensuring accurate descriptions and images, full disclosure of condition or restoration, authenticity where claimed, and compliance with all applicable laws and regulations. Professional sellers may be subject to additional onboarding, verification, or compliance requirements.
Ownership Warranty
By listing an item, the seller represents and warrants that:
- They are the lawful owner of the item, or otherwise hold full legal authority to sell it
- The item is free from any liens, financing interests, or third-party ownership claims
- The sale does not infringe any third-party ownership or intellectual property rights
Licence to Use Seller Content
By submitting a listing, the seller grants TUP a worldwide, royalty-free, non-exclusive licence to use, reproduce, display, publish, and distribute listing photographs, descriptions, and related content for the purpose of operating, marketing, and promoting the Platform.
Prohibited Items & Enforcement
Sellers may list only lawful, safe, and accurately described items. Prohibited items include, without limitation:
- Unsafe or structurally compromised items
- Counterfeit or intellectual-property-infringing items
- Items illegal under UAE law
- Recalled, banned, or restricted items
- Misrepresented or materially altered items without disclosure
TUP may remove listings, restrict privileges, suspend or terminate accounts, withhold escrow payouts pending investigation, or report unlawful activity where required by law.
Cancellations, Suspension & Termination
Orders may not be cancelled once delivery has been scheduled, except in exceptional circumstances. Sellers may cancel a sale only where justified and subject to TUP's approval. Escrow funds will be handled in accordance with these Terms.
TUP reserves the right to suspend, restrict, or terminate accounts where it reasonably believes these Terms have been violated or where necessary to protect the Platform, users, or third parties.
Limitation of Liability & Platform Availability
To the maximum extent permitted by law, TUP shall not be liable for indirect, incidental, consequential, or special damages arising from the use of the Platform or the purchase of items through it.
- TUP relies on third-party service providers, including payment processors, escrow providers, logistics partners, and hosting providers, and is not liable for delays or failures resulting from their acts or omissions.
- The Platform is provided on an "as is" and "as available" basis. Temporary interruptions may occur due to maintenance, upgrades, security measures, or technical issues.
Force Majeure
TUP shall not be liable for any failure or delay in performance resulting from events beyond its reasonable control, including natural disasters, government actions, strikes, war, payment provider outages, logistics disruptions, and internet or telecommunications failures.
Intellectual Property
All content on the Platform, including text, imagery, branding, and design, is the property of The Unique Piece or its licensors and may not be used without prior written permission.
Governing Law
These Terms are governed by the laws of the United Arab Emirates. The courts of Dubai shall have exclusive jurisdiction.
